Lost Car Title in New Jersey: Duplicate and Court-Ordered Titles
✅ 100% Legal Process
✅ Free Towing & Pickup
✅ All Vehicles Accepted
The Short Answer
New Jersey requires the title to sell any vehicle, including a junk car. Unlike Florida, New Jersey has no exemption for older, low-value vehicles. If your title is lost or stolen, the owner of record can apply for a duplicate with the New Jersey Motor Vehicle Commission (MVC) on the Universal Title Application, form OS/SS-UTA. The fee is $60.
When no duplicate is possible, for example with an inherited car whose owner of record cannot sign, the remaining path is a court-ordered title. This guide covers both. To talk through your situation, call our Perth Amboy yard at (732) 709-7989 or request a quote online.
Getting a Duplicate Title
The Universal Title Application (OS/SS-UTA) states plainly that duplicate titles are issued if the current New Jersey title has been lost or stolen. The New Jersey title fee is $60, and adding a lien costs an additional $25. Duplicate title transactions are handled at MVC Vehicle Centers by appointment.
The form’s checklist lists what to bring.
- Valid photo identification for the owner of record.
- A current or expired New Jersey registration, or an insurance card for the vehicle.
- A lien release letter from the lender, if the vehicle was ever financed.
- A notarized Power of Attorney or Letter of Authorization, if a business owns the vehicle.
If you cannot prove ownership in person, the MVC’s duplicate title page explains that a mail request requires form OS/SS-130 along with the OS/SS-UTA.
When the Lender Still Holds the Title
Many sellers believe the title is lost when it was never sent to them. If the car was financed, the lender may still hold the title, or the lien may remain on the record after the loan was paid. Ask the lender for a lien release letter first. With that letter, the MVC can issue a clear title, and the sale can proceed normally.
When a Court-Ordered Title Is Required
Some vehicles have no available path to a duplicate: a car abandoned on your property, a vehicle bought years ago without a proper assignment, or an estate vehicle with complications. The New Jersey Judiciary’s FAQ on court-ordered titles explains that the MVC, not the court, decides whether a court order is needed. Most requests start with the MVC Special Title Unit.
If the MVC requires an order, the Judiciary’s Complaint and Proposed Form of Order for Action Seeking Title to Motor Vehicle (CN 11411) lays out the process. You file a Verified Complaint describing your search for the former owner, a police check for theft, and the VIN. An Order to Show Cause is served on the MVC, the Attorney General and the former owner. The court then issues a Judgment Directing Title. When personal service on the former owner fails, a newspaper notice may be required.
A court-ordered title takes time. For a vehicle worth only its scrap value, weigh that effort against the offer before you begin.
Salvage Titles From Insurance Total Losses
When an insurer declares a car a total loss, New Jersey converts the ordinary title into a salvage certificate of title. Under the MVC’s salvage title rules, N.J.A.C. 13:21-22, a salvage vehicle may not be transferred except by proper assignment and delivery of a salvage certificate of title. The owner or insurer must surrender the ordinary certificate within 10 working days of settling a total-loss claim. If you kept a totaled car and now want to sell it for junk, the salvage title is the document you will sign over.
Why the Title Matters in New Jersey
Without a title, ownership of a New Jersey vehicle never legally transfers, and the seller remains exposed if the car is later abandoned or misused. That is why we help New Jersey sellers obtain the duplicate rather than skip it. In most cases, the $60 duplicate title and a short MVC appointment are all that stand between you and a completed sale with free towing and payment at pickup.
