What to Do With Your Plates and Insurance After Selling a Junk Car

The Short Answer

In both Florida and New Jersey, the license plate stays with you, not the car. Remove it before the tow, surrender it to the state, and only then cancel your insurance. Cancelling insurance first, while the plate is still active, is the most common mistake sellers make, and in both states it can trigger an insurance-lapse notice, fines or a license suspension.

Florida sellers should also file a Notice of Sale. The details for each state are below. Florida sellers can reach us at (561) 203-8970; New Jersey sellers at (732) 709-7989.

Florida: Surrender the Plate, Then Cancel

FLHSMV’s Procedure RS-43, Surrender of a License Plate by Owner states that an owner who plans to cancel insurance on a vehicle with a valid plate should first surrender the license plate and decal, and that an owner who does not is responsible for any unauthorized use of the plate. In Palm Beach County, plates are surrendered at Tax Collector service centers, which issue a receipt.

The cost of getting the order wrong is set by Section 324.0221 of the Florida Statutes. Reinstating a license suspended for lack of insurance costs $150 for the first reinstatement, $250 for the second and $500 for each subsequent reinstatement within three years.

Florida: File a Notice of Sale

The Notice of Sale is the seller’s record that the vehicle has left your ownership. FLHSMV’s form HSMV 82050 is submitted to your local tax collector office; the seller completes sections 1 and 3, and the buyer’s signature is optional. The form also warns that ownership will not change until the purchaser applies for and receives a certificate of title.

Section 319.22(2) of the Florida Statutes requires the seller to notify the department within 30 days of the sale. A seller who complies is not treated as the owner for civil liability purposes when the buyer later operates the vehicle. Sales to licensed dealers are an exception to the notice requirement, but filing the notice is still good practice and costs nothing.

New Jersey: Plates Go Back to the MVC

The MVC’s plates page states that if you sell a vehicle and do not transfer its plates to another vehicle, you must surrender the old plates. Plates can be returned at an MVC agency, placed in an agency drop box or mailed, but they cannot be surrendered at inspection stations. Keep the receipt; it is your proof if charges are later linked to the plate.

The MVC’s Uninsured Motorist Enforcement FAQ explains why the order matters. A vehicle is flagged when an insurance carrier reports that coverage was dropped or cancelled. If you no longer own the vehicle, the remedy is to surrender the registration and plates to the MVC.

The penalty for an uninsured vehicle is significant. Under N.J.S.A. 39:6B-2, a first offense carries a fine of $300 to $1,000, community service and a possible license suspension of up to one year.

A Simple Checklist for Either State

  • Remove the license plate before the tow truck arrives.
  • Remove your toll transponder (SunPass in Florida, E-ZPass in New Jersey).
  • Sign the title over to the buyer and keep a photo of the signed title.
  • Surrender the plate and keep the receipt.
  • Florida only: file the Notice of Sale (HSMV 82050) within 30 days.
  • Cancel the insurance only after the plate is surrendered.

Frequently Asked Questions

Can I leave the plate on the car when I sell it for junk?

No. In both Florida and New Jersey, the plate belongs to the owner, not the vehicle. Remove it and surrender it, or transfer it to another vehicle.

Should I cancel my insurance before or after surrendering the plate?

After. Florida’s FLHSMV procedure RS-43 and New Jersey’s uninsured motorist rules both make the active plate the trigger for enforcement.

Do I need to file a Notice of Sale in Florida?

Section 319.22(2) requires notice within 30 days, with an exception for sales to licensed dealers. Filing HSMV 82050 is still recommended because it documents the date the vehicle left your ownership.

Can I surrender New Jersey plates at an inspection station?

No. The MVC accepts plates at agencies, in agency drop boxes or by mail, but not at inspection stations.
